On February 15th 2016, Russian President Vladimir Putin signed the Federal law “On ratification of the Agreement between the Russian Federation and the United Arab Emirates on mutual legal assistance in criminal matters”.
The Federal law was passed by the State Duma on 29th January 2016 and approved by the Federation Council on 10th February 2016.
The Federal law ratifies the Agreement between the Russian Federation and the United Arab Emirates on mutual legal assistance in criminal matters (hereinafter – Agreement).
The contract was prepared with modern Treaty practice and the legislation of the Russian Federation and international standards, and was signed at Abu Dhabi on 25th November 2014 for development of the international legal framework of Russian-UAE cooperation on mutual legal assistance in criminal matters.
A year later the UAE fulfilled all necessary steps to start the contract procedures. On 10th February this year, the document was ratified by the Federation Council. The implementation of the Treaty from the Russian side will be monitored by the state office of public Prosecutor, from UAE – the Ministry of Justice.
According to the Agreement the Parties undertake, on a reciprocal basis, and under specified terms, to render each other legal assistance in investigations, litigation or other legal proceedings associated with criminal cases. The contract determines the scope of legal aid, establishes the requirements for the form and content of requests for legal assistance, and the manner of its execution.
Countries gave their consent for extradition upon request. Now Russia is asking the UAE to issue it to nine Russians. The criminals will be extradited if they have committed acts that are in accordance with the legislation of both parties, are considered a criminal offense and entail a punishment of deprivation of liberty for a term not less than one year or heavier punishments.
The agreement contains rules other than those stipulated by the legislation of the Russian Federation, as well as the norms, which are subject to regulation by the fundamental rights and freedoms of man and citizen. In this regard, the Treaty is subject to ratification in accordance with subparagraphs “a” and “b” of paragraph 1 of article 15 of the Federal law “On international treaties of the Russian Federation”.
